Sergeant David Ruiz testified that
while on duty on March 23, 1998 at approximately 10:00 p.m., he had

moved toward a white car which was parked beside the bank. Officer Ruiz
testified that when the white males saw him, they started running toward him.
Officer Ruiz stated that when the white males realized that he was a police
officer and not the customers from the bank, they turned back. Officer
